Non Lead Safe Certified Companies Facing Serious EPA Fines

Peeling Paint Hazard for Children

GroupXL, LLC is a Lead-Safe Certified company able to legally perform work under the U.S. Environmental Protection Agency’s (EPA) Lead Renovation, Repair and Painting (RRP) Rule. This regulation covers work that might disturb lead-based paint used in residences (apartments or houses), pre-schools, hospitals and other child care or child occupied facilities built before 1978.

If you are not a Lead-Safe Certified company, you can face a fine up to $37,500 daily for performing certain work in such a residence. This is according to a 2010 law covering maintenance and repair work in those buildings. You should be aware of this if you are a general contractor, plumber, painter, electrician, carpenter, drywaller, property manager, etc. or do renovation work.

EPA Is Auditing Remodeling Firms

GroupXL recently received notice from a company that certifies lead-safe renovators. The EPA is apparently auditing a company they deal with. This auditing process ensure compliance with mandatory testing and paperwork requirements for inspecting for lead based paints on some of their job sites.

I quote from the email notice: “It seems as though the EPA is starting to investigate more residential home remodeling than they have in recent history.”

Real Estate Agent Reponsibilities

Real estate agents are also mandated to take action under federal law in this matter. They must provide information to prospects about lead paint before a buyer signs a purchase contract. Buyers or sellers should be notified they need to hire a certified renovator if they are planning to do repairs or renovations. These steps help protect families who plan to buy and move into homes or apartments built prior to 1978.

Lead Poisoning Is A Serious Matter

Lead poisoning is a serious metal poisoning affecting the brain and other parts of the body. It can cause mental disability, problems in behavior, stomach and blood problems, seizures and even death. Small children are susceptible since they put small objects such as peeling paint chips (such as shown in the picture above) into their mouths.

Be aware of the law and it regulations. Help insure renovations do not accidentally contaminate a residence or a child facility and thereby expose children to hazardous lead paint chips or dust.
